Knowing More About Juvenile Dependency Cases

The reports about child abuse and neglect have been going up these past few years which is why many people have been taking them very seriously. It is because of the alarming rates that the courts have become much stricter with juvenile dependency cases. Now if one would want to have more knowledge about the processes and the people who are involved in these types of cases, here is some information.

Now in order for a kid to file a case against his parents, he has to first be a minor and be dependent on them. Now this usually happens when the parents do not provide the basic needs of the kid or abuses him. When a complaint is filed in the court, the judge will be the one to handle the decision about what will happen to the child so that he will not be subjected to that anymore.

In the event that the court does find that the parents of the children are actually abusive, then they will take the children out of their houses. They will then send them over to a foster family. The foster families will be the ones to assume the role of guardians as instructed by the judge as well as a social worker and will live there temporarily until the judge has reached a final decision on what will happen to the kid.

Now there will be times that the parents will claim that they have changed and they would want to take the child back. Now if this kind of situation arises, the social worker will first evaluate the home whether it is actually safe to go back. Now it is only if the parents pass the evaluation then they can actually take the child back.

Now if the judge really finds that the home is definitely not suitable for the kid to live in, then the court will not allow the parents to take their kid back. From there, the court will create a permanent plan for the child. A permanent plan is when the court will decide as to where the child will live in the long term.

The one who will be finding the best home for the victim would actually be the social worker. Now the job of a social worker as a whole is to first investigate the case to the type of abuse the child is going through. The social worker is also there to make inquiries about where the victim will go after.

From there, the judge will be the one who will make the final decision on what happens to the fate of the child. Take note that there is no jury in the juvenile court which means that the judge will solely be the one to make the decision. When he makes his decision, it is final.

So if one would want to have more knowledge about these kinds of cases, here are some things to note. Now a kid may take his case to court if he feels like he is neglected or abused. That way, he will receive the appropriate justice and treatment he deserves.
